  • Convince the immigration officer that their primary intent for coming to Canada is to study; and/or
  • Persuade the immigration officer that they will leave Canada after their study period ends.

Based on the specific reasons for the refusal, applicants may choose to:

  • Address the stated issues and submit a new application; or
  • Consult a lawyer to assist with an official review of the decision.

Reviewing Canadian Study Permit Requirements When a study permit application is denied, the first step should be to reassess the eligibility criteria.

To qualify for a study permit in Canada, international students must:

  • Have an acceptance letter from a designated learning institution in Canada;
  • Prove they have sufficient funds to cover:
    • Tuition fees,
    • Living expenses for themselves and any accompanying family members, and
    • Return transportation for themselves and any accompanying family members;
  • Be law-abiding with no criminal record and not pose a security risk to Canada, which may require providing a police certificate(s);
  • Be in good health and willing to undergo a medical examination if necessary; and
  • Convince an immigration officer that they will leave Canada at the end of their authorized stay.

Exceptions to these criteria may apply to foreign representatives to Canada and their families, members of certain foreign armed forces, foreign nationals with Registered Indian status, and individuals undertaking short-term studies in Canada (less than six months).

Applying for a Review of the Decision Study permit refusals often result from the applicant not meeting one or more of the eligibility criteria. If an applicant can demonstrate that they do meet the necessary criteria, they may be able to request a review by the Federal Court of Canada.

Typically, a lawyer must submit a judicial review request on behalf of the applicant.
