Your work permit is expiring. You’re protesting for an extension. So can you legally stay in Canada?
This is the question many international graduates — including Indian students — are asking as public demonstrations and calls for immigration policy changes continue.
And here’s the uncomfortable answer:
Protesting does not automatically extend your Canadian work permit.
There has been no blanket federal announcement granting protesters an automatic extension simply because they are participating in demonstrations or publicly asking the government to change work permit rules.
For international graduates, the issue isn’t whether their cause is justified.
It’s whether they still have valid legal status in Canada.
Your Protest Doesn’t Extend Your Work Permit
Canada’s immigration system works according to specific legal requirements.
If you’re in Canada on a Post-Graduation Work Permit (PGWP), your right to work and remain in Canada is connected to your authorized immigration status.
When that authorization expires, you cannot simply continue working because you’re waiting for a political decision or because a campaign is asking Ottawa to provide an extension.
This is especially important for international graduates whose PGWP is expiring and who haven’t yet secured another immigration pathway.
Your permit has an expiry date.
Your immigration strategy needs to account for it.
What Happens When Your PGWP Expires?
A Post-Graduation Work Permit can be an important bridge between Canadian education and employment.
But PGWPs are generally designed as temporary, non-renewable work authorizations.
So what happens when yours reaches its expiry date?
You may need to consider another legal pathway, depending on your circumstances.
Potential options can include:
- Applying for another eligible work permit
- Applying for an employer-specific work permit
- Applying for a study permit
- Changing to visitor status where appropriate
- Applying for permanent residence if eligible
- Applying for restoration of status if your status has already expired
But these aren’t automatic alternatives.

Can You Stay in Canada After Your Work Permit Expires?

Simply remaining physically inside Canada does not mean you continue to have legal status.

That’s why the timing of your application matters.

What Is Maintained Status?
Maintained status — previously known as implied status — can allow an eligible temporary resident to remain in Canada while IRCC processes a timely application to extend their status.
For example, if you are eligible to extend your work authorization and submit the application before your current permit expires, you may be able to remain in Canada under the applicable conditions while waiting for a decision.
However, this is not a universal safety net.
The conditions of your previous authorization and the type of application you submitted determine what you can legally do while waiting.
So if your PGWP is expiring, don’t wait until the final day to figure this out.
What If Your Permit Already Expired?
This is where the situation becomes more urgent.
If your temporary resident status has already expired, you may need to look at restoration of status in Canada.
Eligible applicants generally have a limited period in which they can request restoration.
But restoration is not the same thing as maintained status.
And there can be restrictions on working while your status is being restored.
That means someone who continues working after their authorization expires could potentially create an additional immigration problem.
If your permit has already expired, stop assuming that “I have an application” automatically means “I can keep working.”
Those are two very different things.
Can Protest Participation Help You Get an Extension?
There is currently no general immigration rule that gives international students or graduates an automatic work permit extension because they participated in a protest.
Public pressure can influence political debate.
It can lead to government announcements.
It can contribute to future policy changes.
But until an official immigration measure is introduced, existing immigration rules continue to apply.
That distinction is critical.
Don’t build your immigration plan around a petition, protest campaign, social media announcement or political promise that hasn’t become an official program.
Build it around the rules that actually apply to your status.

Many graduates have relied on their Canadian education and PGWP eligibility to gain Canadian work experience and eventually pursue permanent residence.

Canadian work experience.
Occupation.
Job offer.
Language ability.
Provincial nomination eligibility.
Express Entry profile.
Education.
Age.
Immigration history.
